Probate Disputes
The last thing people want after they die is loved ones fighting over their estate. Unfortunately, conflicts sometimes occur, and fair resolution requires litigation.
Defense of Fiduciaries. We provide representation to executors, trustees, agents and guardians who have been accused of wrongdoing.
Litigation Advocacy for Beneficiaries. We pursue claims on behalf of beneficiaries who are the victims of fiduciary nonfeasance (failure to act in a timely manner), misfeasance (improper behavior or sloppy work that is not criminal) and malfeasance (stealing).
Prevention and Rectification of Elder Abuse. We advocate for people who need protection from mental and/or financial abuse. We make claims on behalf of victims who have been (or fear being) financially exploited.
Guardianship Litigation. We represent persons whose capacity is at issue and their families. We represent family members involved in disputes with regard to the affairs of an incapacitated family member, such as who is best suited to act as guardian.
Will and Trust Contests and Construction Action. We advocate for our clients regarding issues that arise over the validity and proper interpretation of wills and trusts.
